This agreement has been concluded electronically between **Muzaffer FIRAT (FIRAT KONFEKSİYON)** and the "Account Holder" who opens an account on the **https://www.firatkonfeksiyon.com/** website or mobile applications.
1. Parties
This Individual Account Agreement (hereinafter referred to as the “Account Agreement”);
Has entered into force by being concluded electronically between “Muzaffer FIRAT (FIRAT KONFEKSİYON)”, residing at TAYA HATUN MAH. TIĞCILAR SK. NO: 13 INTERNAL DOOR NO: 1 FATIH/ISTANBUL (hereinafter briefly referred to as "FIRAT KONFEKSİYON") and the “Account Holder”, who electronically approves this Account Agreement and its annexes, which are an integral part hereof, as well as all terms and rules published on the Portal, for the purpose of opening an individual account on the website consisting of the domain name https://www.firatkonfeksiyon.com/ and sub-domains linked to this domain name and mobile applications (“Portal”).
FIRAT KONFEKSİYON is an e-commerce platform focusing on the retail and wholesale of **men's, women's, and children's trouser products**. FIRAT KONFEKSİYON offers bulk ordering opportunities to corporate customers and direct fixed-price ordering opportunities to retail users.
2. Definitions
The following terms shall be used with the meanings specified in the contract text:
- “Portal”: The website and/or mobile applications operated by FIRAT KONFEKSİYON, consisting of the domain name https://www.firatkonfeksiyon.com/ and its sub-domains, where services are offered.
- “User”: Every real or legal person accessing the Portal.
- “Account Holder”: The User who opens an account on the Portal and benefits from the services offered within the Portal under the determined conditions.
- “Individual Account Holder”: The User who creates an account on the Portal and benefits from the services offered within the Portal under the determined conditions without any professional or commercial purpose.
- “Individual Account” (“Account”): The status acquired upon the approval notification by FIRAT KONFEKSİYON after the User, who wishes to create an Individual Account, fills out the Individual Account Form on the Portal accurately and completely with true information.
- “Account Agreement”: The electronic agreement consisting of the terms and conditions on the Portal and its annexes.
- “FIRAT KONFEKSİYON Account”: The set of private web pages where the Account Holder performs the necessary transactions to benefit from the services offered within the Portal.
- “FIRAT KONFEKSİYON Services” (“Services”): Applications provided by FIRAT KONFEKSİYON that allow the Account Holder to perform business and transactions within the Portal.
- “Content”: All kinds of information, text, files, images, videos, product data, trouser models, etc., published on the Portal and accessible.
- “FIRAT KONFEKSİYON Interface”: Designs and screens used by Users to view content and query from the FIRAT KONFEKSİYON database.
- “FIRAT KONFEKSİYON Database”: The database belonging to FIRAT KONFEKSİYON where contents accessed within the Portal are stored, classified, queried, and accessed.
- “My Special” (Bana Özel) Page: The personalized page where the Account Holder can benefit from the applications and services on the Portal, and view their personal information and orders.
- “Personal Data”: Any information relating to an identified or identifiable real person pursuant to the Law on the Protection of Personal Data No. 6698 (“LPPD”).
- “Special Categories of Personal Data”: Sensitive personal data as defined in the LPPD.
3. Subject and Scope of the “Account Agreement”
The subject of this Account Agreement is to determine the services offered by FIRAT KONFEKSİYON on the Portal, the conditions for benefiting from these services, and the rights and obligations of the parties.
FIRAT KONFEKSİYON mediates the retail and wholesale of **men's, women's, and children's trouser products** via the Portal.
By accepting this Account Agreement, the User agrees and undertakes to act in accordance with all the terms and rules published on the Portal and all kinds of declarations made by FIRAT KONFEKSİYON.
4. Account Conditions
- In order to be an Account Holder on the Portal, one must be of legal age and the account must not have been temporarily suspended or closed by FIRAT KONFEKSİYON.
- FIRAT KONFEKSİYON may unilaterally terminate this Account Agreement, close or temporarily suspend the Account Holder's account at any time without giving a reason.
- FIRAT KONFEKSİYON has the right not to open or to close the account if the information provided during the application is insufficient, inaccurate, or not up-to-date.
- During the account opening process, the User may be requested to verify their identity and contact information.
5. Rights and Obligations of the Parties
5.1. Rights and Obligations of the Account Holder
- The Account Holder agrees to act in accordance with the rules specified on the Portal, all applicable legislation, and general rules of ethics.
- FIRAT KONFEKSİYON may disclose confidential/personal data belonging to the Account Holder in cases where it has an obligation to provide information to official authorities pursuant to applicable legislation.
- The Account Holder is personally responsible for the security of the username and password used to log in to the FIRAT KONFEKSİYON account.
- The Account Holder accepts that all information and content provided on the Portal are accurate, up-to-date, and lawful.
- The Account Holder cannot transfer this agreement or the rights and obligations thereunder to third parties without the written consent of FIRAT KONFEKSİYON.
- The Account Holder may only perform transactions on the Portal for lawful purposes.
- The database and contents provided by FIRAT KONFEKSİYON may only be used for the purpose of benefiting from the services. Copying and reproduction are prohibited.
- FIRAT KONFEKSİYON is not responsible for defects in the products and services the Account Holder receives from third parties.
- The Account Holder is obliged to immediately notify FIRAT KONFEKSİYON if the information provided during the account creation stage changes.
- It is forbidden to make any attempt that will jeopardize the security of the Portal or FIRAT KONFEKSİYON systems.
5.2. Rights and Obligations of FIRAT KONFEKSİYON
- FIRAT KONFEKSİYON undertakes to provide the services specified in this Account Agreement and to establish the necessary technological infrastructure.
- FIRAT KONFEKSİYON has the right to change, delete, or close access to the services and content provided on the Portal.
- FIRAT KONFEKSİYON may provide links to third-party websites or resources on the Portal, but it is not responsible for these contents.
- FIRAT KONFEKSİYON may remove content that is contrary to the operation of the Portal, law, or general ethics and close the relevant account.
- FIRAT KONFEKSİYON is not obliged to audit whether the user content on the Portal is lawful.
- FIRAT KONFEKSİYON provides the Portal and services “as is”. It cannot be held responsible for system failures and similar situations.
- FIRAT KONFEKSİYON may close the account or reject the application if it determines that the information provided during the application is not correct.
6. Privacy Policy
- FIRAT KONFEKSİYON may use information regarding the Account Holder on the Portal within the scope of the Privacy Policy published on the Portal.
- FIRAT KONFEKSİYON may use the Account Holder's contact information for promotional and informational purposes.
- The Account Holder is responsible for the protection, processing, and transfer of personal data accessed on the Portal within the scope of the LPPD.
- FIRAT KONFEKSİYON takes the necessary measures regarding the protection of personal data within the framework of the LPPD.
- The Account Holder agrees not to disclose their special categories of personal data during the use of the Portal.
7. Intellectual Property Rights
All components of the Portal (FIRAT KONFEKSİYON Database, FIRAT KONFEKSİYON Interface, design, trouser images, product information, etc.) belong to FIRAT KONFEKSİYON or have been obtained by FIRAT KONFEKSİYON through licensing. These rights are protected during the term of the contract.
- The contents on the Portal cannot be reproduced, processed, or distributed.
- Data in the database cannot be copied or transferred to other databases.
- Reverse engineering cannot be performed on systems developed by FIRAT KONFEKSİYON.
8. Changes to the “Account Agreement”
FIRAT KONFEKSİYON, at its sole discretion, may change this Account Agreement and its annexes at any time it deems appropriate by publishing them on the Portal. The changed provisions become effective from the date they are published.
9. Force Majeure
In all cases considered legally force majeure, FIRAT KONFEKSİYON cannot be held responsible for late or incomplete performance or non-performance of its obligations. Force majeure events include natural disasters, war, cyber attacks, technical failures, and similar unavoidable situations.
10. Applicable Law and Jurisdiction
Turkish Law applies in the implementation, interpretation, and all legal relations arising from this agreement. **Fatih/Istanbul Courts and Enforcement Offices** are authorized to resolve any disputes.
11. Entry into Force
This Account Agreement and all annexes referred to in addition to this agreement shall enter into force upon the Account Holder giving electronic approval.
12. Annexes to the “Account Agreement”
The Account Holder accepts that the annexes specified below are an integral part of this Account Agreement, and that they have read and understood their contents:

Annex-1: Terms of Use
These conditions regulate the rules regarding the use of all services offered by FIRAT KONFEKSİYON. By opening an account at FIRAT KONFEKSİYON, the User accepts these terms.
Annex-2: Privacy Policy
FIRAT KONFEKSİYON is committed to protecting the privacy of its users. The collected information is used for the purposes of providing services, ensuring security, and fulfilling legal obligations.
Annex-3: Description and Terms of Use of FIRAT KONFEKSİYON Services
Explains the conditions of use of paid/free services (e.g., bulk purchase form, special production request, campaign tracking) offered through the FIRAT KONFEKSİYON Portal. The User is personally responsible for the content provided.
Annex-4: List of Prohibited Products
Includes product categories that are contrary to legal legislation, dangerous, or specifically prohibited by FIRAT KONFEKSİYON (e.g., sale of non-trouser products, imitation products).
Annex-5: Principles for Changes in User Profile
Specifies procedures for updating profile information, preventing unauthorized changes, and changing company information.
